The great Lasang River was once a rendevouz of people from the highlands and lowlands. I visited the place of the late Felisa Isidro, accompanied by her two heirs, it lies at Sitio Bucana, Brgy. Lasang, Davao City. They were the one who elaborated to me how the river's course have changed as time passes by. During the 1960's, travellling by way of rivers was a common scenario. The Davao River was once the passages of our noble Manobo tribes from Bukidnon, while the Pulangi River in Bukidnon was once the passages of the Muslims from North Cotabato towards the towns of Wao, Malabang, Lanao del Sur. My Muslim history subject had mentioned that Pulangi River was one reason behind for the success of Sultan Kudarat(Kuralat), the greatest Muslim warrior, whose rulership have lasted for almost 4 decades during the Spanish colonial era. It was in Pulangi that Kudarat's supremacy was molded and maintained. Back to this great Lasang River, together with those heirs, we inspected the area, now considered disposable and alienable land upon the recession of river waters. This untitled public land is now planted with coconut and Nipa by the heirs of Isidro. The creeks, brooks, rivers and seashores are owned by the state, however there are provisions and laws prohibiting private persons to own the easement areas provided for these natural water resources. For the rivers, the state has righful ownership over easement area that measures 40 meters from both river banks, while for the creeks, 5 meters on both sides is allocated. Easement areas are synonymous to accretion areas, so these two technical words are use interchangeably by the state. However, in the case where the river have change its course and left behind an area suitable for cultivation and settlement, an appropriate state agency is tasked to distribute this untitle public land for any qualified actual occupants. The state has righful ownership over these accretion areas, and there are intances that the state through the Local Government had utilized these for purposes provided by law such as, reforestration and other ecological project. For those business engaged in quarrying, the state has also rightful ownership over these resources and its right to regulate this enterprising activities is provided also by the policy of the state.
